** In accordance with M.C.A. 25-31-112, beginning July 1, 2015, civil complaint filing fees will increase from $45.00 to $50.00. **

by individuals must be received in the office no later than 4:30 p.m. on

Small claims suits can NOT be for damages. The defendant must be able to be served in Missoula County. The procedure is started by a certified demand letter sent to the defendant and waiting 10 days before filing. There is a $30 filing fee. Attorney's are not permitted and there is a $7000 limit.
Attorney's are permitted in civil court. There is a $12000 limit. Suits can not address personal property issues. Papers must be served by the Sheriff's department, a private process server or a disinterested 3rd party that is over the age of 18 and can serve papers. The cost to file a civil case is $45.
