Proposed Subdivision Regulation Amendments: Subdivision for Lease or Rent

Missoula County was required to adopt regulations governing the review of multiple building/unit scenarios (or “Buildings for Lease or Rent”) by September 1, 2013, as required by Senate Bill 324. These regulations address potential public health and safety issues associated with multiple buildings/units on a parcel, while also making the review process as streamlined as possible.

As part of this adoption process, the Missoula County Subdivision Regulations were required to be amended pertaining to certain “Subdivision for Lease or Rent” references. Senate Bill 324 also requires amendment of the definition of “Division of Land” and “Subdivision” in the Subdivision and Platting Act. Subdivision Exemption text in MCA 76-3-202, 204 and 208 is contained in the Missoula County Subdivision Regulations, and also requires amendment so as to become compliant with SB 324, which deletes these sections.

At their public meeting on September 18, 2013, the Missoula Board of County Commissioners adopted, via Resolution 2013-109 (note the final recorded version will be posted when available), the REORGANIZATION  and Subdivision for Lease or Rent amendments to the Missoula County Subdivision Regulations.
