Items for the July 20th meeting:

• Subsidized Small Lot Option
  A city-initiated text amendment request to amend Section 20.05.040 Development Options of Title 20 City Zoning Ordinance to permit subsidized small lot development as an option in multi-dwelling zoned districts.

• Wind Energy Conversion Systems (WECS)
  A city-initiated text amendment request to revise Section 20.45.080 of Title 20 City Zoning Ordinance to permit installation of WECS within city limits.  The zoning code currently forbids WECS installations.

Item for June 29, 2010 Meeting:

• Rezoning Request - University of Montana

  A city-initiated rezoning request to rezone property from R-8 Residential (8,000 sq. ft per dwelling unit) to OP-3 Public Lands and Institutional located south of the Clark Fork River and the former Milwaukee Road right-of-way in the vicinity of Jacobs Island.  The property is legally described as Plat H, a tract of in the SE 1/4 of Section 22, Township 13 North, Range 19 West in Missoula County. 

  The City Council will conduct a public hearing on this item at 7:00 p.m. on Monday, July 19, 2010, in City Council Chambers at 140 W. Pine Street in Missoula.  

Item for June 15, 2010 Meeting:

• Rezoning Request - 3580 Highway 200 E Rezoning

  A request from Ken Jenkins of Montana Northwest Company to rezone property located at 3580 Highway 200 E from C-C2 (General Commercial) to C-R3 (Residential, 36 dwellings per acre).  This property is legally described as Lots A, B1, C, & D1 of Block 21 of East Missoula Addition, located in Section 24 of Township 13 North, Range 19 West, P.M.M. in Missoula County. 

  The Board of County Commissioners will hold a public hearing on this subdivision at 1:30 p.m. on Wednesday, June 30, 2010, in Room 201 of the County Courthouse at 200 West Broadway in Missoula.  

Item for June 1, 2010 Meeting:

• Title 20 City Zoning Ordinance: Proposed Maintenance Amendments 2010

  This is a consideration of proposed annual maintenance revisions to Title 2. Fifty proposed corrections and clarifications are proposed and are located in various chapters throughout the ordinance.  The proposed revisions can be viewed at the Office of Planning and Grants or on the web at www.co.missoula.mt.us/opgweb/ "News and Updates."

  As directed by the Missoula City Council, the Missoula Office of Planning and Grants has drafted maintenance amendments to the Title 20 Zoning Ordinance intended to clarify or correct language in various sections of the code.  The proposed revisions were drafted after consideration of comments from interested parties, and agencies.

  The Missoula City Council will conduct a public hearing on this item on a date yet to be determined.   

Item for May 18, 2010 Meeting:

• Rezoning Request - 2012 North Avenue

  A request from Eugene Matelich, represented by Tom Orr of P. Mars Scott and Associates, to rezone property located 2012 North Avenue from RM2.7 (residential multi-dwelling) to C2-4 (Community Commercial -- Intensity Designator = 4).

  The Missoula City Council will conduct a public hearing on this item at 7:00 p.m. on Monday, June 7, 2010 in the City Council Chambers at 140 West Pine Street in Missoula.  

Item for May 4, 2010 Meeting:

• Title 20 City Zoning Ordinance Revision - Garage Setbacks

  Considerations of proposed revisions to Chapter 20.110 "Measurements and Exceptions," Section .050 "Setbacks."

  As directed by the Missoula City Council, the Missoula Office of Planning and Grants has drafted revisions to the Title 20 Zoning Ordinance intended to replace the original language in the above-cited section of the code, as well as succeed Interim Urgency Zoning pursuant to Ordinance No. 3466 adopted February 22, 2010.  The proposed revisions were drafted in cooperation with representatives of the Missoula Building Industry Association (MBIA).

  The Missoula City Council will conduct public hearings on this item on dates yet to be determined.

Item for the March 23, 2010 Meeting:

• Missoula County Growth Policy 2005 Update: 2002 Lolo Regional Plan Amendment and Zoning Amendment: (Continued)
  The Missoula County Rural Initiatives Office has been working with landowners in the North Lolo area on a proposal to replace the North Lolo interim zoning due to expire on May 30, 2010. The proposal to replace the North Lolo Interim zoning includes both a growth policy amendment to the 2002 Lolo Regional Plan and a zoning proposal for a rural special zoning district. The North Lolo area is approximately 900 acres in size. The triangular area is located immediately south of Bird Lane; it is bounded by Ridgeway Drive to the south and Hwy 93 to the east. The growth policy amendment proposes changes in land use designations to reflect historical uses and increases in residential densities for some properties in the area. The North Lolo Rural Special Zoning District calls for a mix of residential and mixed use zoning classifications that would implement the land use designations called for in the growth policy amendment. It also establishes a specific set of general requirements, nonconforming use provisions, and conditional use requirements. The growth policy amendment and zoning proposal for the North Lolo area is available for public and agency comment. It can be viewed at www.co.missoula.mt.us/rural.

Item for the March 16, 2010 Meeting:

• Missoula County Growth Policy 2005 Update: 2002 Lolo Regional Plan Amendment and Zoning Amendment:
  The Missoula County Rural Initiatives Office has been working with landowners in the North Lolo area on a proposal to replace the North Lolo interim zoning due to expire on May 30, 2010. • Reconsider motions for the Missoula County Growth Policy 2005 Update: The Target Range Neighborhood Plan
  The Target Range Neighborhood Plan is a 5-year neighborhood plan created by the Target Range Neighborhood Planning Committee in consultation with the Office of Planning and Grants.  The Neighborhood Plan identifies key resources and assets in the neighborhood and recommends strategies and implementation tools to manage change and growth.  Plan sections include the Natural Environment and Human Environment. The draft Plan is proposed to be adopted as an appendix to the Growth Policy after review by the Planning Board, City Council and the County Commissioners through the public hearing process. • Missoula County Growth Policy 2005 Update: The Target Range Neighborhood Plan

• Missoula County Growth Policy 2005 Update:  Sand and Gravel Extraction and WUI Amendments proposed.  Due to changes in state law, the Missoula County Rural Initiatives Office has been directed to develop minor amendments to the County's 2005 Growth Policy dealing with sand and gravel extraction and the Wildland Urban Interface.  The amendments are proposed to be adopted as an appendix to the Growth Policy after review by the Planning Board, City Council and the County Commissioners through the public hearing process. • Subdivision and Planned Variation Request--Blue Heron Subdivision
  A request from the Earl Pruyn Estate (c/o Jack Meyer), represented by Eli & Associates, Inc., to subdivide a 75.01 acre parcel into 16 residential lots.  The property is located on Lavoie Lane, south of Mullan Road in the Council Grove area, in the SW 1/4 of Section 31 in T14N, R20W, and in the NW 1/4 of Section 6 in T13N, R20W.

  The Missoula Historic Preservation Commission in consultation with the Historic Preservation Officer and the University of Montana Law School Land Use Clinic has drafted a Historic Preservation Ordinance.  The purpose of the ordinance is to promote and safeguard the historic integrity of Missoula’s historic resources and neighborhoods, and to stimulate neighborhood revitalization.  The ordinance would apply to properties currently listed in the national Register of Historic Places and properties in Missoula’s nine (9) listed and eligible National Historic Districts:  Missoula Downtown District, East Pine Street District, Northside Railroad District, Lower Rattlesnake, University of Montana, University Area, Historic Southside, McCormick Neighborhood, and Fort Missoula. The list of National Register of Historic Places sites in Missoula can be found at http://www.co.missoula.mt.us/opgweb/HistPres/ along with a draft of the proposed ordinance.  Planning Board will continue its consideration of the draft ordinance.

• PUD Zoning Amendment Request – Canyon Creek Village
  A request from Westmont Builders to amend the Canyon Creek Village PUD zoning in order to revise the density allowance in Subdistrict No. 3 and permit Church uses as a conditional use rather than as a special exception in Subdistric No. 5.  The property is legally described as Reserve B Missoula Airport Development Park/Parcel B, COS #5176, located in Canyon Creek Village, Phase 12 (not yet filed) in the NW1/4 of Section 1, T13N, R20W, P.M.M.

• Public Hearing: Historic Preservation Ordinance

  A request from Dennis Louquet to rezone property located on the northeast corner of the Higgins Ave/South Ave intersection, from R-1 (Residential, 8 dwelling units per acre) to BN (Neighborhood Business).

Item for the June 2nd meeting:

• The Downtown Master Plan
  The Downtown Master Plan is a 25-year community vision spear-headed by the Missoula Redevelopment Agency (MRA), Missoula Business Improvement District (BID), Missoula Parking Commission, and the Missoula Downtown Association. The Plan outlines the fundamental concepts of future land use and transportation, as well as strategies for implementation, which will ensure the long-term health, character and vitality of Missoula’s urban core. The Plan was developed through a public process facilitated by the Missoula BID and the MDA in 2008 which included four (4) public workshops and eighty-five (85) stakeholder meetings. The Plan incorporates the input from this inclusive process and reflects the community’s vision for the future of downtown.

  • Subdivision and Rezoning Request - Linda Vista Estates (Amended Application)
    The Office of Planning & Grants has received a request from Lloyd Twite Family Partnership, represented by Professional Consultants, Inc., to rezone and subdivide property in the Miller Creek Valley generally described as a portion of Tract 3 COS #3455 and a portion of COS #5917, in Section 13, T12N, R20W, P.M.M., containing 95.52 acres, more particularly described by a metes and bounds description in City Resolutions #7285 and #7373.  The rezoning is from C-A3 (Residential 1 du/5 ac) on the south side of Lower Miller Creek Road and "Miller Creek View PUD" on the north side of Lower Miller Creek Road to a combination of R-XII (12.85 acres) and R-I (82.67 acres) zoning.  The subdivision is proposed to create 208 single dwelling lots and 1 multiple dwelling lot designed to allow 132 dwelling units in twelve-plex buildings, to be developed in four phases over 9 years.

  • Subdivision Request - Wye Commercial
    The Office of Planning & Grants has received a request from Ken Williams, represented by WGM Group, Inc., to create a 10-lot commercial subdivision of a 20.11-acre parcel located at 8600 Aluminum Road near the intersection of I-90 and Highway 93, legally described as Tract 2-B-2 COS #3804 in the SE 1/4 of Section 21, T14N, R20W.           
  • Special Presentation - Target Range Homeowners' Association Survey
  Fred Stewart and Peggie Morrison of the Target Range Homeowners' Association will present the results of a comprehensive survey they conducted in their neighborhood.           
  • Special Presentation - Greater Downtown Master Plan for Missoula, MT
    The Downtown Business Improvement District of Missoula, represented by consultants Crandall Arambula, will present the Greater Downtown Master Plan for Missoula Montana.  The Plan includes planning for the physical development of the downtown, ensuring it is a future-oriented, and geographically-inclusive.  The Plan looks at the entire downtown.  Elements of the plan will include a designation of preferred land uses, development of public facilities, and an analysis of transportation and circulation patterns.

    A proposal to amend City Subdivision Regulations Article 3-8 (Park and Open Space Requirements) to require parkland dedication for minor subdivisions creating 4 or 5 lots and a proposal to provide a new method of calculating parkland dedication for lots created through subdivision intended for multi-family housing.  Additionally, a proposal to amend Title 19 Missoula City Zoning Ordinance to add a new chapter that will require parkland dedication for development of 4 or more dwelling units on a single lot.
  • Growth Policy Amendment - Urban Fringe Development Area Project (Continued from September 16th)
    City Council and the Board of County Commissioners are initiating an amendment to the Missoula County Growth Policy.  The proposal is a result of the Urban Fringe Development Area (UFDA) Project which focuses on developing a regional context for allocating residential development within the Urban Service Area.  The amendment includes four specific objectives and a new map of residential development allocation in the Urban Service Area.  The purpose of the amendment is to help guide future public infrastructure planning and investment, evaluation of future rezoning proposals, and set parameters for future neighborhood planning within the Urban Service Area.

  Item from the September 16th meeting:

  • Zoning Regulation Revision - CBD (Central Business District)
    City Council is initiating a revision to the Missoula City Zoning Ordinance, Chapter 19.26.090 Central Business District (CBD), Permitted Uses to allow structures that contain ground floor commercial uses and residential units, at least 40% of which are affordable, as determined by the Office of Planning and Grants (Based on HUD and MBOH standards), with no limit on density.  Included with the above proposed addition to permitted uses in chapter 19.26 is the deletion of the conditional use:  Structures containing more than sixteen (16) units per acre.  The purpose of the ordinance is to encourage higher-density, mixed use development that includes affordable residential units in the Central Business Zoning District.
  • Urban Fringe Development Area Plan Update - Special Presentation
    OPG Director Roger Millar will present an update on the work to date on the UFDA Project.  The UFDA Project focuses on developing a regional context for allocating residential development within the Urban Service Area.  Items discussed will include the three scenarios that were developed for the May Open Houses, the suitability analysis based on key infrastructure and resource considerations, the staff recommended scenario which brings together consideration of many elements (including existing Growth Policy goals, public comment, already-allocated lots, and the suitability analysis, the proposal for a Growth Policy Amendment), and potential implementation tools.

  • Rezoning Request - Condos at Canyon River
    Canyon River Development, LLC proposes to rezone a 4.72 acre parcel along the east bank of the Clark Fork River, south of Deer Creek Road and adjacent to the Canyon River Subdivision and Golf Course from RLD-1 (Residential, one dwelling per acre) to RLD-4 (Residential, four dwelling units per acre) and P-1 (Open Space District).  The property is currently zoned C-RR1 in the County and is proposed to be annexed into the City with a zoning designation of RLD-1.
  • Rezoning Request - Carter's Court PUD
    The City of Missoula Parks and Recreation Department proposes to rezone Carter's Orchard Homes Subdivision located south of River Road and approximately one block east of Lafray Lane from RLD-4 (Residential, four dwelling units per acre) to Carter's Court PUD zone.  The applicant proposes to convert the 6,512 sq. ft. park lot at the south end of the Carter Court cul-de-sac into a residential home site, with the proceeds from the sale of the lot used to fund improvements to Lafray Park located just west of the subdivision.

  A request from Lloyd Twite Family Partnership to rezone and subdivide property as a portion of COS #3455 and COS #5917 in Section 13, T12N, R20W containing 93.64 acres. The rezoning is from C-A3 (Residential 1 du/5 acres) on the south side of Lower Miller Creek Road and "Miller Creek View PUD" on the north side of Lower Miller Creek Road to the "Linda Vista Estates PUD" on the entire acreage to allow for a total of 293 dwelling units.   Subdivision and Rezoning Request - Pontiac Development Park
  Mathew and Kathleen Whetzel propose to create an 8-lot commercial/light industrial subdivision on 20.52 acres located on Roller Coaster Road approximately .5 miles west of U.S. Highway 10 West. The property is primarily zoned C-I1 (Light Industry). The southern 150 feet of the property is zoned C-RR1 (Residential, 1du/1 acre) and is proposed to be rezoned to C-I1 (Light Industry).
  
  Rezoning Request - Lower Rattlesnake P-1
  Missoula City Council requests to rezone parcels in the Lower Rattlesnake from P-1 Open Space to R-1 Residential, located at 910 Taylor, 1112 Cherry, 1125 Cherry, 1139 Cherry, 1204 Poplar, 1208 Poplar, 1220 Poplar, 1221 Poplar, 1240 Poplar, and 1310 Vine. A Planned Unit Development prohibits structures above a certain elevation and is proposed to apply to portions of this area. 
  
  Zoning Amendment - Windsor Park Special Zoning District
  B&E Corporation requests to amend the Windsor Park Special Zoning District. The zoning district currently permits porches, decks and stairs to be built within the front yard setback if set back a minimum of 4 feet of the front property line. The amendment would permit stairs to be built up to the front property line.
