Recent Montana Land Use related Legal Decisions
and Legislation
Kitty Casillas will discuss statewide issues and recent legislation that is likely to affect land use decisions in all jurisdictions in the state. The presentation will include detailed discussion of the court decisions in existing planning law as it relates to land use planning in Montana. Ms. Casillas is the Administrator for the Community Development Division with the Montana State Department of Commerce. As part of her position she oversees the Community Technical Assistance Program (CTAP), which is a program that provides technical assistance to local governments and planning departments.

The Missoula County
Rural Initiatives Office has been working with landowners in the
North Lolo area on a proposal to replace the North Lolo interim
zoning due to expire on May 30, 2010. The proposal to replace the
North Lolo Interim zoning includes both a growth policy amendment to
the 2002 Lolo Regional Plan and a zoning proposal for a rural
special zoning district. The North Lolo area is approximately 900
acres in size. The triangular area is located immediately south of
Bird Lane; it is bounded by Ridgeway Drive to the south and Hwy 93
to the east. The growth policy amendment proposes changes in land
use designations to reflect historical uses and increases in
residential densities for some properties in the area. The North
Lolo Rural Special Zoning District calls for a mix of residential
and mixed use zoning classifications that would implement the land
use designations called for in the growth policy amendment. It also
establishes a specific set of general requirements, nonconforming
use provisions, and conditional use requirements. The growth policy
amendment and zoning proposal for the North Lolo area is available
for public and agency comment. It can be viewed at

The Downtown Master Plan is a 25-year community vision spear-headed by the Missoula Redevelopment Agency (MRA), Missoula Business Improvement District (BID), Missoula Parking Commission, and the Missoula Downtown Association. The Plan outlines the fundamental concepts of future land use and transportation, as well as strategies for implementation, which will ensure the long-term health, character and vitality of Missoula’s urban core. The Plan was developed through a public process facilitated by the Missoula BID and the MDA in 2008 which included four (4) public workshops and eighty-five (85) stakeholder meetings. The purpose of the amendment is to help guide future public infrastructure planning and investment, evaluation of future rezoning proposals, and set parameters for future neighborhood planning within the Urban Service Area.

City Council is initiating a revision to the Missoula City Zoning Ordinance, Chapter 19.26.090 Central Business District (CBD), Permitted Uses to allow structures that contain ground floor commercial uses and residential units, at least 40% of which are affordable, as determined by the Office of Planning and Grants (Based on HUD and MBOH standards), with no limit on density. Included with the above proposed addition to permitted uses in chapter 19.26 is the deletion of the conditional use: Structures containing more than sixteen (16) units per acre. The purpose of the ordinance is to encourage higher-density, mixed use development that includes affordable residential units in the Central Business Zoning District.

Special Presentation
OPG Director Roger Millar will present an update on the work to date on the UFDA Project. The UFDA Project focuses on developing a regional context for allocating residential development within the Urban Service Area. Items discussed will include the three scenarios that were developed for the May Open Houses, the suitability analysis based on key infrastructure and resource considerations, the staff recommended scenario which brings together consideration of many elements (including existing Growth Policy goals, public comment, already-allocated lots, and the suitability analysis, the proposal for a Growth Policy Amendment), and potential implementation tools.
